Terms of Use

These Terms of Use (hereinafter referred to as the “Terms”) set forth the conditions for using the services (hereinafter referred to as the “Service”) provided on this website by IMUKA TIMUKAT PARIS (hereinafter referred to as the “Shop”). All users (hereinafter referred to as “Users”) are required to use the Service in accordance with these Terms.

Article 1 (Scope of Application)
These Terms shall apply to all relationships between the User and the Shop regarding the use of the Service.

Article 2 (User Registration)
Registration shall be completed when a person wishing to register applies for registration in accordance with the method specified by the Shop, and the Shop approves such application.

The Shop may refuse to approve a registration application if it determines that the applicant falls under any of the following, and shall have no obligation to disclose the reasons:

Article 3 (Management of User ID and Password)
Users shall manage their User ID and password for the Service at their own responsibility.

Under no circumstances may Users transfer or lend their User ID and password to any third party. If a login is made using a combination of User ID and password that matches the registered information, the Shop shall deem such use as being made by the registered User.

Article 4 (Fees and Payment Methods)
Users shall pay the fees displayed on this website, as separately निर्धारित by the Shop, as consideration for the use of the Service, using the payment methods designated by the Shop.

Article 5 (Prohibited Acts)
Users shall not engage in the following acts when using the Service:

  8. Any other acts deemed inappropriate by the Shop

Article 6 (Suspension of the Service)
The Shop may suspend or interrupt all or part of the Service without prior notice to Users if it determines that any of the following applies:

  1. When performing maintenance, inspection, or updates of the system related to the Service
  2. When the provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
  3. When computers or communication lines are stopped due to accidents
  4. When the Shop otherwise determines that the provision of the Service is difficult

The Shop shall not be liable for any disadvantage or damage suffered by Users or third parties due to such suspension or interruption, regardless of the reason.

Article 7 (Restriction of Use and Deregistration)
The Shop may, without prior notice, restrict a User’s use of all or part of the Service or cancel their registration if:

  1. The User violates any provision of these Terms
  2. It is found that there is false information in the registration details
  3. The Shop otherwise determines that the use of the Service is inappropriate

The Shop shall not be liable for any damages incurred by the User as a result of actions taken under this Article.

Article 8 (Disclaimer)
The Shop shall be exempt from liability for non-performance of obligations unless such non-performance is due to willful misconduct or gross negligence. Even if the Shop is held liable for any reason, compensation shall be limited to the amount of fees paid and to damages that would ordinarily arise.

The Shop shall not be responsible for any transactions, communications, or disputes arising between Users and other Users or third parties in relation to the Service.

Article 9 (Changes to the Service)
The Shop may change the content of the Service or discontinue its provision without prior notice to Users, and shall not be liable for any damages incurred by Users as a result.

Article 10 (Amendments to the Terms)
The Shop may revise these Terms at any time without prior notice to Users if it deems it necessary.

Article 11 (Notices and Communications)
Notifications or communications between Users and the Shop shall be made in accordance with the methods specified by the Shop.

Article 12 (Prohibition of Assignment of Rights and Obligations)
Users may not assign, transfer, or pledge as collateral their contractual position or any rights or obligations under these Terms to any third party without prior written consent from the Shop.

Article 13 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of France. In the event of any dispute arising in connection with the Service, the court having jurisdiction over the Shop’s registered address (28 Avenue de Wagram, 75008 Paris, France) shall have exclusive jurisdiction.
